The terms of using this website and ordering a PC from us. Plain language where we can; numbered clauses for the bits that need precision. Governed by Ontario law. The legal entity behind these terms is Exponential Labs, Inc. dba mygamingpc.ca, headquartered in Toronto, Ontario, Canada.

1. Who we are

The legal entity behind mygamingpc.ca is Exponential Labs, Inc. dba mygamingpc.ca, an Ontario company with its registered place of business in Toronto, Ontario, Canada. In these terms, “mygamingpc.ca,” “we,” “us,” and “our” refer to Exponential Labs, Inc. dba mygamingpc.ca. “You” means the person using the website or placing an order.

2. Using this website

You agree to use the website lawfully and in accordance with these terms. You agree not to: scrape or automated-crawl the site at a rate that disrupts service, attempt to access non-public areas, interfere with other users’ access, upload or transmit malware, or use the site to harass any person.

We don’t offer customer accounts in v1, so the typical “account responsibilities” clauses don’t apply. If we add accounts later, we’ll update this section and notify recent customers.

3. Ordering a PC

The lead form on this site is a request for a quote, not a binding order. An order becomes binding when (a) you have accepted a written quote from us by email and (b) we have received payment in full or, where we’ve agreed to a deposit, the agreed deposit. Until both conditions are met, either party may cancel without obligation.

We reserve the right to refuse an order in honest cases — for example, if a part has become unavailable, if a pricing error appeared on the site, or if we cannot verify the buyer. Where we refuse, we will explain the reason and refund any payment or deposit promptly.

Pricing on the site is in Canadian dollars and is exclusive of applicable taxes. We make best efforts to keep pricing accurate; if a clear error appears, we’ll notify you before processing payment and offer the corrected price or a full refund.

4. Payment

We accept payment methods listed on the quote we email you. All amounts are in Canadian dollars. Applicable sales taxes (HST/GST/PST) are charged based on the shipping or pickup address per Canadian tax rules.

Payment is due in full before the build window begins, except where we have agreed in writing to a deposit-and-balance schedule.

5. Shipping and risk of loss

We ship from Leaside, Toronto. Transit windows by region are listed on the shipping page. Risk of loss passes to you on delivery (or, in the case of pickup, on collection from the workshop). Transit damage is covered for 30 days from delivery — see warranty for the claim process. Photograph any visible damage as soon as you open the box and email us immediately.

6. Returns and exchanges

We offer a 14-day return window from delivery date.

  • Unopened PCs — full refund, including original shipping cost. We arrange pickup or a return label at our cost.
  • Opened PCs — refund less a $99 restocking fee, provided the PC is in as-received condition with all original packaging and accessories. We arrange pickup or a return label at our cost.
  • Custom or special-order builds — quoted on a case-by-case basis; the terms are stated in the quote you accept.

To start a return, email [email protected] with your order number. Refunds are processed within five business days of receipt.

7. Warranty

Each PC ships with a parts and labour warranty for the term stated on the product page (currently 2 years), plus lifetime tech support by email. Full terms, what’s covered, what isn’t, and how to file a claim are on the warranty page. The warranty is provided by Exponential Labs, Inc. dba mygamingpc.ca.

8. Intellectual property

All content on this website — copy, illustrations, the founder avatar, the honeycomb pattern, the “mygamingpc.ca” mark, the brand spine line “Loved by kids. Trusted by parents. Made in Leaside.” — is owned by Exponential Labs, Inc. dba mygamingpc.ca or used under licence. You may share links and short quotations with attribution. You may not reproduce substantial portions of the site, scrape the content for training datasets without permission, or use our marks in a way that suggests endorsement.

Third-party trademarks (Microsoft, Intel, AMD, NVIDIA, AMD, Mojang/Microsoft, Epic Games, Roblox Corporation, Discord, etc.) are the property of their respective owners and are referenced for accurate description only.

9. User content

We don’t accept user content (reviews, testimonials, comments, uploads) in v1. The data/reviews.php file on our server is intentionally empty and we don’t display any user-contributed content. If we accept user content in a future version, we’ll publish a clear policy and update this clause.

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to your use of the website or your purchase is limited to the amount you actually paid us for the PC in question (or, where no PC was purchased, $100 CAD). We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or loss of business opportunity.

Nothing in these terms limits liability that cannot be limited under applicable Canadian or Ontario law — including liability for fraud, gross negligence, or for damages arising from product defects under consumer protection statutes. Where a clause of these terms would otherwise be unenforceable, it applies to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Exponential Labs, Inc. dba mygamingpc.ca, its officers, directors, and the Kavan-as-builder, from any third-party claim arising out of your breach of these terms, your misuse of the website, or your unlawful use of a PC purchased from us. This indemnity is mutual: we’ll act in good faith and won’t pursue indemnity for trivial or technical breaches.

12. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. The courts of Ontario have exclusive jurisdiction over any dispute arising from or relating to these terms or your use of the website. Where applicable, your statutory consumer protection rights remain unaffected.

13. Changes to these terms

We may update these terms from time to time. The “Last updated” stamp at the top of this page reflects the most recent change. For material changes — for example, changes to refund policy or warranty terms — we’ll email recent customers directly. Continued use of the website or placement of a new order after a change constitutes acceptance of the updated terms.
